LEG 7.1. – The Passive Voice: Simple Tenses

Future Simple

They will soon promoted him to the post of Legal Director.

He will soon be promoted to the post of Legal Director.

Future Perfect Simple

This time next week they will have scheduled the new hearnig.

This time next week the new hearning will have been scheduled.

 

USES

 

1     Describing a process or procedure

We use the passive because we are more concerned with the process itself than who carries it out.

The company was set up in 1997.

The company has been taken over.

The same grammatical rules of simple tenses apply to the passive sentences as to the the active sentences (see Units 1, 2, 3 and 4 on present, past and future tenses).

 

2     Reporting unconfirmed information

When the statement is speculative we use the passive of say, think, consider, believe followed by an infinitive. This structure is common in newspaper reporting:

 The minister is said to be in favour of decreasing corporation tax.

The board is thought to be in favour of a merger.

He is considered to be the best chairman the company has ever had.

The terrorists are believed to want a new ceasefire.

EXERCISE 1

The jury trial. The following passage describes the steps of a trial in the US. Put the words in brackets into the appropriate form, using the passive when necessary. 

1. Opening of the Court and Swearing in the Jury

2. Opening Statements by Respective Attorneys (Claimant’s Attorney/Prosecuting Attorney/Defendant’s Attorney)

3. Direct Examinations and Cross-examinations of witnesses ___1___ (perform) respectively by the Claimant’s Attorney / the Prosecutor and the Defense

4. Judge’s Instructions to the Jury and the Closing statements (US) / Closing speeches (UK)

5. Jury Deliberations and the Announcement of the Verdict by Jury/Judge

 

a. The jury ___2 ___ (tell) to leave the courtroom and ___3____ (go) to a separate room to discuss the case and to make a final decision in the case, then they ___4___ (report) it back to the courtroom. This decision of a jury ___5___ (be) the final one in the trial. In a criminal trial, the verdict for the defendant will be “guilty” or “not guilty”. In a civil case, the jury ____6____ (require) to follow the instruction of the judge.

b. The court ___7___ (open) by the clerk of the court or the judge by announcing that the court ____8___ (be) ready to begin. d. One lawyer ___16___ (tell) the jury the important information concerning the case, ___17___ (state) the parties to the case, and the reasons for the lawsuit. The other lawyer ___18___ (introduce) himself and his client, and ___19___ (present) the defendant’s version of the case to the jury.

e. The respective witnesses ___20___ (call) one at a time to the front of the courtroom, ___21___ (ask) by the judge to swear the truth and ___22___ (ask) questions by the attorney.
